These Terms and Conditions govern your use of malaysiamarketing.my and the services provided by Malaysia Marketing (“we”, “us”, “our”). By using our website or engaging our services, you agree to these terms.
1. Services
We provide digital marketing, web development, SEO, e-commerce, integration and related services. The specific scope, deliverables, timeline and fees for any engagement are set out in a separate proposal, quotation or order that forms part of these terms.
2. Quotations and fees
Quotations are valid for the period stated and are subject to acceptance. Fees are payable as set out in the relevant proposal or order. Unless stated otherwise, prices are exclusive of any applicable taxes.
3. Client responsibilities
You agree to provide accurate information, materials, access and timely feedback needed for us to deliver the services. Delays in providing these may affect timelines and costs. You confirm you have the rights to any content you supply to us.
4. Payment
Invoices are due within the period stated on the invoice. We may suspend services on overdue accounts after reasonable notice. Deposits and milestone payments, where agreed, are payable before the related work begins.
5. Intellectual property
On full payment, ownership of the final deliverables created specifically for you transfers to you, except for third-party materials, open-source components and our own pre-existing tools, frameworks and know-how, which remain owned by their respective owners or by us and are licensed to you for use within the deliverables.
6. Third-party services
Our services may rely on third-party platforms, plugins and providers. We are not responsible for the availability, performance or terms of those third parties, though we will use reasonable care in selecting and configuring them.
7. Confidentiality
Each party agrees to keep confidential the non-public information of the other party disclosed in the course of an engagement, and to use it only for the purpose of that engagement.
8. Warranties and disclaimers
We will perform the services with reasonable skill and care. We do not guarantee specific rankings, traffic, sales or results, as these depend on factors outside our control, including search engine and platform changes. Except as required by law, the website and services are provided on an “as is” basis.
9. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in connection with an engagement shall not exceed the fees paid by you for the services giving rise to the claim. We are not liable for indirect, incidental or consequential losses, including loss of profit, revenue or data.
10. Termination
Either party may terminate an engagement as set out in the relevant order, or with reasonable written notice. On termination, you remain liable for fees for work performed up to the termination date.
11. Refunds
Refunds, where applicable, are governed by our Refund Policy, which forms part of these terms.
12. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia shall have jurisdiction over any dispute arising from them.
13. Changes to these terms
We may update these terms from time to time. The current version will always be posted on this page with a revised date. Continued use of our website or services means you accept the updated terms.
